US Court Mandates Freedom of Abrego Garcia from ICE Detention

A court has ordered the immediate release of Kilmar Abrego Garcia from immigration custody, finding his continued confinement lacks lawful basis.

"Since Abrego Garcia's return from wrongful detention in El Salvador, he has been re-detained, again without lawful authority," Judge Paula Xinis wrote in her ruling.

The situation originates in a mistaken removal to El Salvador earlier this year, which US authorities later admitted was an error. Following his repatriation to the United States to answer alien smuggling charges, he was detained in federal custody.

In her order, the court noted that the authorities does not have a current deportation order, which effectively blocks them from removing Mr. Abrego Garcia "for now."

Context of the Legal Challenge

The legal challenge involve disputed assertions. Whereas the former administration argues that Abrego Garcia is a member of the MS-13 gang, he categorically disputes this allegation.

He has also entered a not guilty plea to the conspiracy counts, which are part of a ongoing trial in Tennessee.

Conditions of Freedom

The judge, who was hearing his challenge to removal in a Maryland district court, determined that he must now adhere to the conditions of his bond from jail in Tennessee. This decision effectively transfers his supervision to the jurisdiction handling his criminal case.
